If I auto-enrol employees on a sacrifice basis, will allowing them to revert to higher cash pay on opting out create a tax charge?

No. HM Revenues & Customs has clarified that employees who opt-out of salary sacrifice or out of pension savings will not be penalised. Their employment contract will be amended as a consequence of them reverting to higher cash. http://www.hmrc.gov.uk/

What if an employee is still serving a probationary period – do they have to be auto-enrolled?

Yes. If the employee is working or ordinarily working in the UK and satisfies the age and salary criteria, they must be auto-enrolled within three months of joining the company or of meeting the criteria, whichever is later.
